1. Acceptance of Terms

By accessing this website and applying for membership, you agree to be bound by these Terms & Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with any local New Mexico state laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Membership Eligibility & Dues

Membership in the New Mexico Outdoor Recreation Business Alliance (NMORBA) is open to businesses, non-profits, and government agencies active in the outdoor recreation sector.

Tiers: Membership is tiered based on annual business revenue. You agree to select the tier that accurately reflects your organization’s size.
Payment: Dues are payable annually. Access to member benefits, including the Directory and advocacy resources, is granted only upon successful payment.
Non-Refundable: As outlined in our Refund Policy, all membership dues are final and non-refundable.

3. Professional Conduct & Ethics

Members of NMORBA are representatives of the New Mexico outdoor industry. By joining, you agree to:

Conduct business with integrity and in accordance with state and federal conservation laws.
Respect the diversity of the outdoor community and maintain a professional demeanor at all all NMORBA events and digital forums.
NMORBA reserves the right, at the discretion of the Board of Directors, to suspend or revoke membership for conduct that is detrimental to the reputation or mission of the Alliance.

4. Use of the Member Directory

The NMORBA Member Directory is a tool for professional connectivity and consumer awareness.

Prohibited Use: Members and visitors may not use the Directory for mass solicitation, "spamming," or scraping data for third-party marketing lists.
Accuracy: Members are responsible for keeping their directory listings accurate and up-to-date.

5. Intellectual Property

The NMORBA name, balloon logo, and proprietary research/reports are the intellectual property of the Alliance.

Member Badge: Active members are granted a limited license to display the "NMORBA Member" badge on their own websites and marketing materials.
Restricted Use: Use of the primary NMORBA logo in a way that implies an official endorsement of a specific product or service requires prior written approval from the Executive Director.

6. Advocacy & Lobbying Disclosure

NMORBA is a 501(c)(6) non-profit business league. A portion of your membership dues may be used for advocacy and lobbying efforts to support the outdoor recreation industry. Under Section 6033(e) of the Internal Revenue Code, the portion of dues used for lobbying is generally not deductible as a business expense.

7. Limitation of Liability

NMORBA provides resources and networking opportunities "as is." While we strive for accuracy, the Alliance makes no warranties, expressed or implied, regarding the specific business outcomes of membership. NMORBA shall not be liable for any damages arising out of the use or inability to use the materials on our website.

8. Governing Law

Any claim relating to NMORBA’s website or membership agreements shall be governed by the laws of the State of New Mexico without regard to its conflict of law provisions.
